Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus forbearing the 1st to 5th respondents from dumping or leveling or damaged the Kulachal Kulam Pond and not to issues any patta to the third parties in Kulachal Kulam Pond comprised in old survey no.262, new survey no.408, 409 situated at Karmangudi Village, Srimushnam Taluk, Cuddalore District, by considering the petitioner representation dated 24.06.2025 and 05.07.2025 and consequently direct the 1st to 5th respondents to restore the water body and maintain the same. ORDER

(Order of the Court was made by the Hon'ble Chief Justice) On the allegation that the subject land is part of the pond, learned State counsel, upon instructions, submits that patta has been issued in favour of private persons and according to him, it is

not part of pond.

2. Be that as it may, once patta has been issued in favour of private persons, the petitioner may approach the higher authorities by filing an appeal as provided under Section 12 of the Patta Passbook Act, 1983 and the Rules framed thereunder.

3. With the abovesaid liberty, petition is dismissed. There shall be no order as to costs.
