ORDER

This Criminal Original Petition has been filed to call for the records in C.C.No.176 of 2017 pending on the file of Learned Judicial Magistrate No.III, Vellore, Vellore District and to quash the proceedings against the petitioner. https://hcservices.ecourts.gov.in/hcservices/

2. Learned counsel for the petitioner submitted that the counter case is already taken cognizance in S.C.No.98 of 2017 which is still pending before the Chief Judicial Magistrate, Vellore and seeks that both the matter can be tried together and direction may be issued in this regard.

3. In view of the above, as the counter case is already taken cognizance, assuming it to be case in counter, both the cases shall be conducted simultaneously following the case in counter procedure. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petitions are closed.
