..Respondent(s) Prayer: This writ petition is filed to call for the records of the respondents particularly that of the 1st respondent in G.O.Ms.No.259, Finance (Pension) Department dated 06.08.2003 and consequently quash the same as illegal, improper and against rule of law, consequently to direct the respondents herein to provide all the benefits accrued to the petitioner under the old pension scheme based on her services primary school teacher computable from her date
of joining on 16.06.2003 continuously and extend medical insurance, increment as applicable under the service rules computable with effect from 16.06.2023 until date of superannuation on 31.01.2023 and issue pension book by assigning specific number.

ORDER
The petitioner has filed this writ petition to call for the records of the 1st respondent in G.O.Ms.No.259, Finance (Pension) Department dated 06.08.2003 and consequently quash the same as illegal, improper and against rule of law, consequently to direct the respondents herein to provide all the benefits accrued to the petitioner under the old pension scheme based on her services primary school teacher computable from her date of joining on 16.06.2003 continuously and extend medical insurance, increment as applicable under the service rules computable with effect from 16.06.2023 until date of superannuation on 31.01.2023 and issue pension book by assigning specific number.
2. When the matter was came up for hearing today, learned Special Government Pleader appearing for the respondents would submit that the matter is no longer res-integra and the same is covered by the dictum laid down by this Court in W.P.No.535 of 2025 dated 23.06.2025. The Division Bench of this
Court while dealing with the same issue held as follows and the relevant paragraph is extracted hereunder:- "4. In view of the earlier order passed by this Court in W.P.Nos.11497 & 18132 of 2024, dated 04.02.2025, this Court is of the view that the petitioners are not entitled to the claim raised by them in the writ petition. Hence, we are not inclined to entertain the present writ petition. Accordingly, this writ petition stands dismissed. Connected miscellaneous petitions are closed. There shall be no order as to costs."
3. In view of the ratio laid down by this Court in W.P.No.535 of 2025 dated 23.06.2025, the Government Order vide G.O.Ms.No.259 Finance (Pension) Department dated 06.08.2003, passed by the first respondent does not warrant any interference by this Court and the same is hereby confirmed.
4. In the result, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. 20-02-2026 Index: Yes/No Speaking/Non-speaking order VM
