ORDER
This Criminal Revision Case has been filed to set aside the order dated 27.06.2024 passed by the Principal Family Court, Chennai.
2. The first petitioner herein is the wife of the respondent, who filed petition under Section 125 Cr.P.C to direct the respondent/husband to pay a sum of Rs.10,000/- as maintenance to the petitioner. On hearing both sides, the Court below allowed the petition and directed the respondent to pay a sum of Rs.10,000/- to the first petitioner and Rs.5,000/- each to the second and third petitioners as maintenance. Challenging the same the petitioners filed this Revision Case.

The learned counsel for the petitioner submits that second son of the petitioner is suffered with eye problem to that effect he produced the medical records which shows that he is having eye sight problem and another son is aged about 20 years. Further, the petitioner is working in Air Force Station and earning Rs.60,000/- per months. However, without considering the salary of the petitioner the Court below awarded very less amount as maintenance. Further, the petitioners are living in rented house. Hence, he prays to enhance the maintenance amount.
4. The learned counsel for the respondent submits that the respondent is paying maintenance without any default and considering the take home salary of the petitioner the Court below rightly fixed maintenance and the respondent is going to retire in two years . Hence, he prays to dismiss this case.
5. Heard the submission of the learned counsel for the petitioners and the learned counsel for the respondent.
6. Considering the facts and circumstances of the case as well as the salary of the respondent and also the second and third petitioners are under the custody of the first petitioner. Hence, this Court is inclined to enhance the maintenance from Rs.20,000/- to Rs.27,000/-. Accordingly, the respondent is directed to pay a sum of Rs.15,000/- to the first petitioner, Rs.5,000/- to the second petitioner and Rs. 7,000/- to third petitioner. The said maintenance shall be paid from the month of October 2025. If the respondent failed to pay the maintenance, the petitioners is entitled to recover the maintenance from the respondent from his retirement benefits as per manner known to law.
