2. Heard Mr.S.Venkataraman, learned counsel for petitioner and Mr.C.Selvaraj, learned Additional Government Pleader appearing for respondent.
3. The grievance of the petitioner is that the charge memo was issued to the petitioner on 18.04.2023 and the same is kept pending without any progress for more than a year. The petitioner is reaching the age of superannuation on 30.11.2024. Therefore, the petitioner wants to see the light in the end of the tunnel before his retirement. It is under these circumstances, the present writ petition has been filed before this Court seeking a direction to the respondent to complete the disciplinary proceedings before 30.11.2024.
4. Learned counsel for respondent submitted that the respondent is willing to go ahead with the disciplinary proceedings and there is no co-operation from the petitioner.
5. The above submission made by learned counsel for respondent is strongly refuted by learned counsel for petitioner. Learned counsel submitted that it is in the interest of the petitioner to get the 2/4
disciplinary proceedings completed before his retirement. Therefore, there is no reason for the petitioner not to co-operate for the completion of disciplinary proceedings.
6. Considering the facts and circumstances of the case and considering the submissions made on either side, it will suffice if a direction is issued to the respondent to complete the disciplinary proceedings on its own merits and in accordance with law and after affording sufficient opportunity to the petitioner on or before 04.11.2024. This writ petition is disposed of with the above direction. No costs.
