ORDER

This Criminal Miscellaneous Petition is filed to suspend the sentence imposed upon the petitioners by the learned XI Additional Special Judge, (CBI cases relating to Banks and Financial Institutions), Chennai in C.C.No.61 of 2003, by its judgment, dated 30.06.2025 and enlarge them on bail, pending disposal of the appeal.

2. Learned Senior Counsel for the petitioners would submit that fine amount is already paid and the sentence remains suspended as on date by the Trial Court.

Considering the nature of sentence and that it remains suspended by the Trial Court as on date and that it will take for a while for this Court to get the appeal papers made ready and the appeal to be taken up for hearing, it is only appropriate that the sentence be suspended pending disposal of the main appeal.

4. Accordingly, this Criminal Miscellaneous Petition is ordered by suspending the imprisonment alone on the following conditions:- (i) The petitioners shall execute a bond for a sum of Rs.25,000/- with two sureties, each for a likesum to the satisfaction of the Trial Court; (ii) The petitioners and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank pass Book and mobile numbers to ensure their identity;

(iii) The petitioners shall appear before the Trial Court on the first working day once in every three months at 10.30 a.m., and if they are not able to appear before the Trial Court on any day, they shall make arrangements to file an application under Section 355 of BNSS, 2023 and shall appear before the Trial Court on any other day in lieu of the date of their absence, as directed by the Trial Court; 4/6
