A.Nos.1867 and 1872 of 2022 in C.S.No.477 of 1993 and Tr.C.S.No.129 of 1994 N.SESHASAYEE, J.

These two suits were laid against the two independent Trusts for framing a scheme.

2.While the plaintiff, who are common in both suits claim that the Trust is a public Trusts, the defendant contends that they are private Trusts. These applications are taken out by the 1st defendant in both the suits to denote them as private Trusts.

3.Whether the two Trusts involved in these two litigations are public Trusts or Private Trust is a matter for adjudication. This court does not consider it appropriate to pre-empt and find that these Trusts are private Trusts or public Trusts, that would be adjudicated at the appropriate stage of the suits. For the present, these applications are closed.
