O R D E R

This Criminal Miscellaneous Petition has been filed by the petitioner seeking extension of time to comply with the order of this Court dated 17.08.2023 made in Crl.O.P.No.18350 of 2023, wherein this Court had directed the petitioner to deposit a sum of Rs.3,12,000/-.

2. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Criminal Side) appearing on behalf of the second respondent.

3. The learned counsel for the petitioner submitted that due to health issues, the petitioner is unable to comply with the direction of this Court and sought extension of time to comply with the order of this Court dated 17.08.2023.

4. On a bare perusal of the order of this Court dated 17.08.2023, it is seen that there was a specific direction to the petitioner to deposit a sum of Rs.3,12,000/- which is 20% of the compensation awarded by the trial Court, within a period of two weeks from the date of receipt of the said order. It was further stated in the order that if the petitioner fails to comply with the

order within the stipulated time as specified by this Court, the Court below shall take steps to make the petitioner to undergo the sentence imposed by the trial Court.

It is pertinent to note that after lapse of two years, the petitioner has approached this Court for extension of time on the ground of medical issues, to comply with the order of this Court dated 17.08.2023. However, the medical ground raised by the petitioner has not been substantiated by any relevant documents before this Court as if she is suffering from any health ailments. Hence, this Court does not find any merit in the contention of the learned counsel for the petitioner and accordingly, the Criminal Miscellaneous Petition stands dismissed.
