ORDER

This petition has been filed to quash the proceedings in C.C.No.687 of 2023 pending on the file of the learned Judicial Magistrate No.II, Alandur.

2. When the matter came up for admission, this Court passed the following order on 04.09.2023:

"

Mr.A.Damodaran, learned Additional Public Prosecutor takes notice on behalf of the 1st respondents.

2. Notice to the 2nd respondent, returnable in four weeks. Private Notice is also permitted.

3. Taking into consideration the political rivalry between the parties, this Court deems it fit to refer the parties for mediation. In the meantime, proceedings in C.C.No.687 of 2023 shall be kept in abeyance.

4. The personal presence of the petitioner is dispensed with pending disposal of the Criminal Original Petition.

5. Post this case after four weeks."

3. The parties were thereafter referred to mediation and today, the matter is posted before the Court with the mediation report. It is seen that the parties have arrived at a settlement through a settlement agreement, 2/6

dated 19.09.2023. For proper appreciation, the terms of the agreement are extracted hereunder:- "

1. Disputes and differences had arisen between the Parties hereto and Crl.Op.No.19663 of 2023 was filed on 21.08.2023 before Hon'ble High court of Madras.

2. The matter was referred to mediation / conciliation vide an order dated 04.09.2023 passed by Hon'ble Justice Anand Venkatesh.

3. The parties agreed that Mr.R.Ramasamy their Mediator/ Conciliator Would act as their Mediator/Conciliator.

4. The meeting held during the process of Mediation /Conciliation dated on 19.09.2023 and the parties have with the assistance of the mediator / Conciliator voluntarily arrived at an amicable solution resolving the above-mentioned disputes and differences.

5. The parties hereto confirm and declare that they have voluntarily and of their own free will arrived at this Settlement Agreement in the presence of Mediator/Conciliator

6. The following settlement has been arrived at between the Parties hereto:

A. Rs.25,000/- Twenty five thousand amount settled to the De facto complainant in this above cases.

B. On today 19.09.2023 both parties are compromise in mediation.

C. Defacto complainant agreed to withdraw the criminal case and the proceedings.

7. By signing this Agreement the Parties hereto state that they have no further claims or demands against each other with respect to Crl.Op.No.19663 of 2023) and all disputes and differences in this regard have been amicably 3/6

settled by the Parties hereto through the process of conciliation /Mediation."

4. The mediation report shows that the parties have reached a settlement and resolved the dispute.

5. In view of the above, this Court quashes the proceedings in C.C.No.687 of 2023 on the file of the learned Judicial Magistrate No.II, Alandur in terms of the settlement arrived between the parties. Accordingly, this Criminal Original Petition is allowed. Consequently, connected miscellaneous petition is closed.
