..Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, seeking for Writ of Mandamus, directing the respondents to release the Earth Moving Machine (JCB) bearing Registration No.PY 01 AE 2907 which was seized by the 2nd respondent on 02.06.2016 and thereby consider the representation dated 17.08.2016.

O R D E R

Heard Mr.G.Punniakoti, learned counsel appearing for the petitioner and Mr.R.Govindasamy, learned Special Government Pleader accepting notice for the respondents. By consent, the writ petition is taken-up for final disposal.

2. The petitioner seeks a direction to the respondents to release the Earth Moving Machine (JCB) by considering the representation dated 17.08.2016.

3. The learned Special Government Pleader appearing for the respondents submitted that the second respondent is entitled to initiate confiscation proceedings and it is not known as to whether the notice has been issued in this regard.

4. However, considering the fact that the representation dated 17.08.2016 is pending, this Court, while declining to give a positive direction, directs the second respondent to consider the petitioner's representation dated 17.08.2016 and pass appropriate orders, within a period of three weeks from the date of receipt of a copy of this order.

5. Accordingly, this writ petition is disposed of. No costs.
