No.3821/ 2017 passed by Motor Accident Claims Tribunal (III Judge Court of Small Causes, Chennai) in terms of Section 174 of the Motor Vehicle Act 1988 along with interest at 7.5% per annum from the date of filing the Claim petition i.e. 12.07.2017 and remit the same to the Bank Account No.6364211222 at Madras High Court Branch-IFSC Code No.IDIB000M157 directly by NEFT and TTGS mode.

O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to recover the compensation amount payable to the petitioner as per the award passed in M.C.O.P.No.3821 of 2017 by the Motor Accident Claims Tribunal, Chennai, in terms of Section 174 of the Motor Vehicles Act along with interest at the rate of 7.5% p.a. from the date of filing of the petition till the date of recovery.

2. Heard Mr.J.Muthukumaran, learned counsel for petitioner and Mr.E.Vijay Anand, learned Additional Government Pleader appearing for first respondent.

3. When the matter was taken up for hearing, learned Additional Government pleader produced the instructions received from the first respondent. On going through the same, it is seen that already the first respondent is in the process of initiating proceedings under the Revenue Recovery Act for recovery of the amount along with interest.

4. In view of the above, there shall be a direction to the first 2/4

respondent to proceed further with the recovery of the compensation amount along with interest and the entire process shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above direction. No costs.
