from the date of numbering of the claim petition i.e. 02.09.2016 till the date of realization as per the Award dated 09.07.2019 of the Motor Accident Claims Tribunal, Chennai-104 (III Judge, Court of Small Causes, Chennai - 104) in MACTOP No.5517/2016 and as per the certificate dated 09.08.2023 issued by the Tribunal in terms of Section 174 of the Motor Vehicle Act 1988 and remit the same in the bank account mentioned in the above said Award.

O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the first respondent to recover the compensation amount payable to the petitioner as per the award passed in MACTOP No.5517/2016 by the Motor Accident Claims Tribunal, Chennai, in terms of Section 174 of the Motor Vehicles Act along with interest at the rate of 7.5% p.a. from the date of filing of the petition till the date of recovery.

2. Heard Mr.J.Muthukumaran, learned counsel for petitioner and Mr.E.Vijay Anand, learned Additional Government Pleader appearing for first respondent.

3. When the matter was taken up for hearing, learned Additional Government pleader produced the instructions received from 2/4

the Tahsildar, Wallajabad. On going through the same, it is seen that already proceedings were initiated under the Revenue Recovery Act for recovery of the amount along with interest.

4. In view of the above, there shall be a direction to the first respondent to proceed further with the recovery of the compensation amount along with interest and the entire process shall be completed within a period of eight (8) weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above direction. No costs.
