Criminal Revision Petition filed under Section 397 r/w 401 of Cr.P.C., / 438 r/w 442 of BNSS Act to set aside the order passed in Crl.M.P.No.2699 of 2025 dated 18.06.2025 on the file of the learned Special Judge for EC/NDPS Act Cases, Chennai and direct the respondent to release the vehicle bearing Regn.No.TN-14AC5502, MAGMA GRAY Colour Chassis No.MBHCZCB3SNMB38233, Engine /Motor No.K12NP1339845 Swift VXI which was seized in connection with the Cr.No.293/2024 on the respondent police to the petitioner. O R D E R
The present Revision has been filed as against the order passed in Crl.M.P.No.2699 of 2025 dated 18.06.2025 on the file of the learned Special Judge for EC/NDPS Act Cases, Chennai, thereby dismissing the petition for returning the property.
2. Heard the learned counsel on either side and perused the documents placed on record carefully.

The petitioner owned a four wheeler bearing registration no.TN14AC5502 and the same was used by the accused for transportation of Ganja weighing 21 kgs and hence after registration of FIR they were arrested and vehicle used for transportation of contra band was also seized by the respondent and produced before the court. The petitioner filed an application for return of property and the same was dismissed, as against the same, the present Revision has been filed.
4. It is the contention of the learned counsel for the petitioner that the Page 2 / 5
accused were detained in the police station on 12.12.2024 at about 12.40 hrs by the Sankarnagar Police Station, thereafter, they were seized by the respondent alleging that they were found in the possession of ganja weighting 24 kgs , therefore, this Court considered the case and released on bail. The petitioner is not an accused and his vehicle was never involved in the transportation of contra band.

On perusal of the record, it reveals that Sankarnagar police station intercepted the vehicle, which was driven by the petitioner to transport Ganja and even assuming that the accused persons were detained by the other police station, the vehicle, is now used for transportation of ganja and the vehicle was simply given to the accused for rental purpose without even a driver and the vehicle was detained for transportation of ganja weighing 21 Kgs, hence it is liable to be confiscated under proceedings. Therefore, the court below rightly dismissed the petition and this Court finds no infirmity or illegality in the order passed by the trial court.
