The above Criminal Original Petition, being one filed by the de facto complainant seeking to cancel the bail granted by the Principal District and Sessions Judge, Thiruvallur by order dated 20.7.2023 in Crl.M.P.No.3074 of 2023, having been allowed by order of this court dated 20.6.2024, is, now, once again placed on the board only for resolving the financial dispute between the parties, in view of the inclination shown on behalf of the parties and the consequent observation made by the Apex Court in its order dated 19.11.2024 in SLP(Crl.) No.8371 of 2024, allowing the Criminal Appeal and thereby setting aside the order dated 20.6.2024 passed by this court.

2. Heard the learned counsel for the parties on the issue, who had expressed their willingness for resolving the issue through mediation by bearing the fee of the Mediator equally and thereby, with their consent, Mr.N.Kirubakaran, Former Judge, High Court, Madras is appointed as Mediator to mediate the issue between the parties.

3. Registry is directed to place the matter before the Mediator and the parties are directed to appear before the Mediator at Tamil Nadu Mediation and Conciliation Centre attached to this Bench on 16.12.2024 at 10.30 am.

4. The fee of the Mediator shall be determined on the value of the main relief in accordance with Fourth Schedule of Arbitration and Conciliation Act, 1996, which, shall be borne by both the parties equally. List the matter before this court with the Mediation Report on completion of the mediation proceedings.
