PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, directing the respondent Inspector of Police, to receive the petitioner's narration statement; to receive the petitioner's incriminating documents; and to include the petitioner as a witness in Crime No.102/2022 on the file of the respondent Inspector of Police and to investigate the involvement and the roles played by the above said named persons in para 26 of the affidavit and others and to take appropriate penal action under law, against them.

ORDER

The learned counsel for the petitioner submits that the petitioner claims that he has some information, it will be helpful for the investigation in Crime No.102 of 2022. The petitioner who is a member of the Arch Diocese of Madras Mylapore Society, has a grievance that a property of the Mylapore Diocese Society been sold illegally for personal advantage. This complaint against the accused has been closed as mistake of facts.

2. However, the police has taken cognizance of offence alleged to have been committed by the accused in respect of disposing the valuable property of the Arch Diocese of Madras Mylapore Society and the same is under investigation in Crime No.102 of 2022 on the file of the ACP II, Team I, Tambaram Police Commissionerate.

3. If the petitioner has any information worth to assist the investigation of the case, then police cannot deny to receive the same or deprive the petitioner from disclosing facts which is well within his knowledge. Therefore, it is necessary to direct the Investigation Officer in Crime No.102 of 2022 to cause notice to the petitioner herein for production of documents available with him and probe the matter in accordance with law.
