2. Mr.D.Nitin learned counsel for Mr.D.Venkatachalam, learned counsel for the second respondent has raised serious objection in allowing this petition.
3. The petitioner would aver that he was undergoing treatment for his back pain and hence, delay of 1115 days occurred in filing the Civil Miscellaneous Appeal.
4. The reasons assigned by the petitioner appear to be acceptable and reasonable.
