CORAM

THE HONOURABLE MR. JUSTICE R.SUBBIAH Crl.O.P.No.373 of 2016 R.Kasthuri ... Petitioner Vs The Inspector of Police, Minjur Police Station, Minjur, Thiruvallore District. ... Respondent Criminal Original Petition filed under Section 482 Cr.P.C. to direct the respondent police to register the petitioner's complaint dated 15.10.2015.

For Petitioner :

Mr.S.Ramesh Kumar For respondent :

Mr.C.Emalias, Addl.Public Prosecutor.

ORDER

The present criminal original petition has been filed seeking a direction to the respondent police to register the petitioner's complaint dated 15.10.2015.

2. It is the case of the petitioner that she has been working as a daily wage employee at M/s.Blud Star Farms at Kalaji Village, Thiruvellavayal, for the past 15 years. There is a dispute between the proprietor of the said firm viz., Paulraj and the villagers viz., one Kumar, Balaji and Munusamy for several years. While so, the said Kumar, Balaji and Munusamy insisted the petitioner's family not to work in the said firm and threatened them and attacked the petitioner's brother and caused head injury on 25.9.2015. Thereafter, on 14.10.2015, the said Kumar, Balaji and Munusamy came to the petitioner's house and started to scold her in filthy language and tried to attack her and threatened her with dire consequences.

Hence, she lodged a complaint with the Superintendent of Police at Thiruvallore on 15.10.2015, who in https://hcservices.ecourts.gov.in/hcservices/

turn, forwarded the same to the respondent police. But, till date, no action was taken on the said complaint. Hence, the petition.

3. Learned Additional Public Prosecutor submitted that the dispute between the parties is purely civil in nature. Further, the learned Additional Public Prosecutor submitted that absolutely, no supporting document was enclosed along with the complaint to show that this petitioner was attacked by the counter petitioners. Thus, he opposed to give a direction to the respondent police to register the petitioner's complaint dated 15.10.2015.

4. Keeping the submissions made on either side, I have carefully gone through the materials available on record and I find that except a bald and vague statement, no material was placed before this Court to show that the petitioner was attacked by the counter petitioners.

5. Under such circumstances, I am not inclined to entertain the prayer made in the petition. Hence, the criminal original petition is dismissed. However, the petitioner is at liberty to work out her remedy in a manner known to law, if she is so advised.
