O R D E R

The petitioner, who was arrested and remanded to judicial custody on 24.11.2023, for the offence punishable under Sections 8(c) read with Sections 22(c), 23(c), 28 and 29 of NDPS Act, 1985 in R.R.No.58 of 2023, registered on the file of the respondent, seeks bail. 1/4

This Court on 09.07.2024 in Crl.O.P.No.11119 of 2024 has considered the petitioner's bail petition elaborately considering various points fro the purpose of satisfying Section 37 of NDPS Act and dismissed the petition. Again, on 28.11.2024, the petitioner's bail petition in Crl.O.P.No.25545 of 2024 was once again dismissed finding no change in circumstances. It is seen that, petitioner has also approached the Apex Court challenging the order passed in Crl.O.P.No.25545 of 2024 and the same was withdrawn.

3. Now, this is the 3rd bail petition filed before this Court stating that in one of the previous cases, petitioner got acquitted. He further submitted that, in another case also there is a likelihood that it will end in his favour. Hence, the learned counsel for the petitioner seeks for grant of bail to the petitioner.

4. It is seen that, this Court had earlier dismissed the petitioner's bail petition after elaborately considering the merits of the case and after holding that the petitioner has not satisfied the twin conditions as contemplated under Section 37 of NDPS Act, had rejected the petitioner's 2/4

bail petition. It is also observed that, this Court considering the gravity of the offence committed by the petitioner and the fact that if the petitioner is released on bail, he would hamper the trial proceedings and also considering the fact that if the petitioner is released on bail, there is a likelihood that he will involve in similar ofence, since he was found guilty and got convicted. Spl.S.C.No.86 of 20216. Therefore, I am not inclined to revisit the earlier order.
