O R D E R

The petitioners herein are the accused in S.C.No.42 of 2024 pending on the file of the Fast Track Mahila Court, Erode District. One Vijayalakshmi, who is the wife of the first petitioner, has committed suicide in jumping into a canal along with her two minor daughters. One of the villagers nearby tried to rescue them, however, the wife and one of the daughter of the first petitioner died and one of the daughter survived. Before committing suicide, the deceased Vijayalakshmi has sent a voice message to her relative and the same has been retrieved by the police and it was found that she has informed her relatives that she is going to commit suicide along with her daughters, as she is unable to bear the cruelty and torture of her husband and her in-laws.

Further, the minor, who survived, had given a statement before the learned Judicial Magistrate, which was recorded under Section 164 Cr.P.C., implicating the petitioners by saying soon before the incident, the deceased Vijayalakshmi being put to dowry harassment and torture, had been humiliated by her husband, mother-in-law and father-in-law.

2. In view of the above facts, the judgment cited by the learned 2/4

counsel for the petitioner to quash the criminal complaint, does not apply. Hence, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
