O R D E R
The petitioner, who arrested and remanded to judicial custody on 09.06.2025, for an offence punishable under Section 8(c) read with 20(b)(ii)(B) of NDPS Act, 1985 read with Section 25(1A) of ARMS Act, 1959 @ under Section 8(c) read with 20(b)(ii)(C) of NDPS, 1985 read with Section 25(1A) of ARMS Act, in Crime No.1379 of 2024, registered on the file of the respondent, seeks bail.
2. According to the prosecution is that, on 15.11.2024, three persons were arrested and from each of them 2 kgs of ganja was recovered. Based on the information given by the arrested persons, the premises of A1 were searched and 21 kgs, 8 kgs, and 7 kgs of ganja were subsequently recovered.
3. The learned counsel appearing for the petitioner submits that the petitioner is the wife of the 1st accused and has nothing to do with the alleged offence.
4. The learned Government Advocate (Crl. Side) appearing for the respondent submits that the case was initially registered for intermediate 2/6
quantity on seizure of 6 kgs of ganja, since 15 kgs of ganja were later seized from the premises of A1, the charges were altered to commercial quantity. It is further submitted that, based on the confession statements of the accused persons, the petitioner was alleged to have assisted the 1st accused in packing ganja into small quantities and she was arrested on 09.06.2025.
5. This Court, on perusal of the case diary finds that no contraband was seized either from this petitioner or from her premises and she has been implicated in this case based of the confession statements of the co-accused.
6. The learned counsel for the petitioner further submits that all the other accused have already been granted bail.
7. In such circumstances, this Court is of the view that the confinement of the petitioner in prison is not required. Hence, this Court is inclined to grant bail to the petitioner, subject to certain conditions. 3/6

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a likesum to the satisfaction of the learned XV Metropolitan Magistrate, George Town, Chennai, [a] The sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] The petitioner shall appear before the respondent police daily at 10.30 a.m., until further orders.
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
