Transfer civil miscellaneous petition filed under Section 24 of the Code of Civil Procedure, seeking to withdraw the case in HMOP.No.156 of 2021 on the file of the Family Court Karur and transfer the same to the files of Family Court, Tiruppur, having competent jurisdiction.

O R D E R

The petition has been filed by the wife seeking to transfer of HMOP.No.156 of 2021 pending on the file of the Family Court, Karur to Family Court, Tiruppur. Transfer is sought for mainly on the ground of convenience, since the wife is a resident of Ponnakali Valasu, Sammandampalayam, Tiruppur. 2.While Mr.Govi Ganesan, learned counsel appearing for the petitioner would submit that the conduct of the proceedings at the Family Court at Karur would pose lot of difficulty to her, since she has to travel from Tiruppur to Karur for every hearing, as the Family Courts Act, requires a presence before the Court for every hearing.

3.Mr.Balaji, learned counsel appearing for the respondent/husband would submit that if the proceedings are to be transferred to the Family Court Tiruppur, the husband will be put to the same inconvenience which the wife is facing now. Mr.Balaji would therefore suggest that the proceeding could be transferred to a neutral venue and a Sub Court which will be https://hcservices.ecourts.gov.in/hcservices/

more convenient for the parties. He would also add that the Sub Court at Kangeyam is within 11kms from the residence of the petitioner/wife.

4. Considering the same and the convenience of the parties HMOP No.156 of 2021 is withdrawn from the file of the Family Court, Karur and transferred to the Sub Court, Kangeyam to be disposed of in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
