ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 24.11.2021 for the offences under Sections 392, 397 of IPC, in Crime No.523 of 2020, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner waylaid the de facto complainant and at knife point robbed a sum of Rs.1,000/-. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he is no way connected with the alleged offence and he has been falsely implicated in this case and he would further submit that the petitioner has been suffering incarceration for more than 10 days from 24.11.2021. Hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the petitioner is an habitual offender and he has got 31 previous cases against him and if is released on bail there is every possibility of the petitioner getting abscond and thereby, the investigation would be stalled.

5. Considering the fact that the petitioner is an habitual offender and he has got 31 previous cases and considering the submission of the learned Government Advocate (Crl. Side) that there is possibility of the petitioner getting abscond and that the investigation has not been completed, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
