PRAYER: Petition filed under Section 24 of the Code of Civil Procedure, to withdraw the O.P.No.10/2021 on the file of the IV Family Court at Chennai and transfer the same to the Sub Court Ambur Camp.

ORDER
The petitioner/wife has filed this petition seeking transfer of the proceedings pending on the file of the IV Additional Family Court Chennai in O.P.No.10/2021 to the file of the Sub Court Ambur Camp on the ground that the petitioner is residing at Ambur along with her 11 months old child in the care and custody of her parents. The husband has not given any maintenance to his wife and his child and this being the case she is now made to travel all the way to Chennai to attend each and every hearing of the O.P.No.10/2021. She has to necessarily take her 11 months old child along with her and this is causing a great deal of financial strain on her parents who are already burdened with looking after herself and her minor child. The petitioner would also not be able to travel by herself with a small child and therefore she would pray that the matter be transferred from the file of the IV Additional Family Court, Chennai to Sub Court Ambur Camp.
2. Taking into account the reasons given above which are justified, I am of the view that the proceedings now pending on the file of the IV Additional Family Court Chennai in https://hcservices.ecourts.gov.in/hcservices/
OP.No.10/2021 should be withdrawn and transferred to the file of the Sub Court Ambur Camp. The Transfer Civil Miscellaneous Petition is therefore allowed as prayed for.
