PRAYER :Civil Revision Petition filed Article 227 of Constitution of India, praying to set aside the order dated 17.04.2024 passed in Crl.M.P.No.3526 of 2021 in D.V.C.No. 25 of 2019 on the file of the learned Judicial Magistrate Court-II, Tambaram, directing the petitioner to pay interim maintenance of Rs.4,000/- per month.

ORDER

The civil revision petition is filed challenging the order passed by the learned Magistrate directing the petitioner to pay interim maintenance of Rs.4,000/- per month.

2. Against the impugned order passed by the learned Magistrate, an 1/4

appeal shall lie under Section 29 of Domestic Violence Act as per the law laid down by the full bench of this Court in Arul Daniel and Others Versus Suganya reported in (2022) SCC Online Mad 5435. In view of the same, I am not inclined to entertain the revision. Accordingly, the civil revision petition is dismissed with liberty to the petitioner to file regular appeal before the jurisdictional Sessions Judge.

3. The petitioner is entitled to exclude the time taken by him in prosecuting the revision before this court, i.e., from 14-07-2025 to the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petition is closed.
