Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 87 to forthwith initiate appropriate action against the 9th respondent, Sri Ramakrishna Nursery & Primary School, Kumarakuppam, Valavanur, Villupuram for constructing and operating a school without proper approvals, in violation of educational, building and safety laws and consequently direct the 7th and 8th respondents to take immediate enforcement action under Sections 56 and 57 of the Tamil Nadu Town and Country Planning Act, 1971, against the unauthorized construction and use of the school premises by the 9th respondent. ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Challenge to the construction by the 9th respondent on the ground of it being in serious violation of the guidelines and norms in
the matter of running private schools, is the issue raised in this petition.
2. The status report filed by the respondents states that the construction, which, at the inception was illegal, has now been regularised under the existing rules and guidelines. Without challenge to the regularisation, no further proceedings can be drawn. Therefore, this petition is disposed of with liberty to the petitioner to take such remedy as may be available, if the petitioner intends to challenge the action and the order of regularisation of construction.
