ORDER

This petition has been filed seeking for the transfer of investigation in Cr.No.213 of 2023 pending on the file of the second respondent.

2. The learned Additional Public Prosecutor, on instructions, submitted that there are two named accused persons in this case and they had cheated nearly 73 victims on the ground that they will get job and thereby, they had collected nearly Rs.91.51 lakhs from the victims.

3. The learned Counsel for the petitioner submitted that the investigation is far from satisfactory and till date, no amount has been recovered and that apart, the accused persons have been released on statutory bail on the expiry of 60 days when specifically the F.I.R was registered for offence under Sections 409 of I.P.C which is punishable for more than ten years and hence, the statutory period is 90 days.

4. Taking into consideration the facts and circumstances of the case, there shall be a direction to the first respondent to transfer the investigation pending on the file of the second respondent to the District Crime Branch, 2/4

Kallakurichi. The first respondent shall monitor the investigation and the investigation shall proceed effectively and it shall be completed and Final Report shall be filed as expeditiously as possible. The transfer of investigation shall take place within a period of ten days from today.

5. This Criminal Original Petition is disposed off with the above directions.
