The petitioner, who was arrested on 12.11.2020 and remanded to judicial custody for the offences punishable under Sections 8(c) r/w 20(b)(ii)(c), 25, 28 & 29 of NDPS Act, 1985 in R.R.No.57 of 2020 in N.C.B.F.No.48/1/13/2020 on the file of the respondent police and the same was taken on file in C.C.No.170 of 2021 before the learned I Additional Special Judge for NDPS Cases, Chennai, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused person were found to be in possession of 288 Kgs. Of Ganja. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl.Side) submits that the petitioner was in possession of 288 kgs of ganja and the same was seized by the respondent Police. He further submitted that this is the fourth bail petition filed by the petitioner and there is no change of circumstances.

5. Considering the fact that the seized contraband is a commercial quantity and hence, grant of bail is barred under Section 37 of NDPS Act and further there is no change of circumstances in this case, this Court is not inclined to grant bail to the petitioner.
