The Original Petition has been filed seeking probate of the last Will and the testament dated 20.10.2020, executed by Mrs.Sarla Bhargava, who died on 08.05.2021.
2. Her husband had predeceased her and had died on 24.03.1994. The respondents are her 3 daughters and one son. The petitioner is the executor named under the Will. After completing procedure, the parties were invited to tender evidence.
3. The petitioner examined himself as P.W.1. The original Will dated 20.10.2020 was marked as Ex.P1 and the Death Certificate of the testatrix Mrs.Salra Bhargava was marked as Ex.P3 and the Death Certificate of her husband was marked as Ex.P2. The Legal Heirship Certificate was marked as Ex.P4.
4. The petitioner also examined as P.W.2, Mrs.K.Mahalakshmi. She was one of the attesting witness. She identified Ex.P1, the Will and also stated that it was executed in her presence and that she signed in the Will. She specifically stated that the testatrix was in a sound and disposing state of mind at the time of execution of the Will. Her affidavit was marked as Ex.P10.

5. The 4th respondent was examined as R.W.1 and the consent affidavits given by the 1st to 4th respondents were marked as Exs.R1 to R4.
6. In view of the evidence presented, the petition stands allowed. Probate is granted.
