Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the second respondent to register the Preliminary Partition Decree of the learned Principal District Court, Kallakurichi, dated 15.04.2025, made in O.S.No.328 of 2024, in accordance with law.

ORDER

This Writ Petition is filed, praying for a mandamus to direct second respondent to register the Preliminary Partition Decree of the Principal District Court, Kallakurichi, dated 15.04.2025, made in O.S.No.328 of 2024.

2. At the outset, it is submitted by Mr.Abishek Moorthy, learned Government Advocate, appearing for the respondents, that the writ petition is premature, inasmuch as there is no refusal slip and there is nothing to indicate that the Preliminary Decree was even presented before second respondent. In any event, he would submit that it is always open to the petitioner to present/re-present the above decree and, on such presentation/re-presentation, the same would be considered and registered, if it is otherwise found to be in order.

3. In view of the above, the petitioner is directed to present/represent the above Preliminary Partition Decree before second respondent and, on such presentation/re-presentation, second respondent shall register the same, if it is otherwise found to be in order. If, for any reason, registration is sought to be refused, the respondent would assign reason for refusing registration.

4. Writ Petition stands disposed of accordingly. No costs. 29.07.2025 NCC :
