Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the 1st respondent to consider the representation of the petitioner dated 30.12.2024 seeking rectification of wrong entries in the petitioners Revised pension payment order (TNAMBOO246185)with respect to wages as on 15.11.1995 wages on the date of exit and the pensionable salary and pass necessary and appropriate orders within the time that may be fixed by this Honourable Court.

O R D E R

This Writ Petition has been filed for the following reliefs:- " directing the 1st respondent to consider the representation of the petitioner dated 30.12.2024 seeking rectification of wrong entries in the petitioners Revised pension payment order (TNAMBOO246185)with respect to wages as on 15.11.1995 wages on the date of exit and the pensionable salary and pass necessary and appropriate orders within the time that may be fixed by this Honourable Court."

2. It is the case of the petitioner that he had joined Vellore Cooperative Sugar Mills Ltd., as a Manufacturing Chemist on 07.12.1981. He had subsequently served in various sugar mills in different capacities and ultimately retired from service on 10.03.2003 as Chief Chemist in M.R.Krishnamoorty Co-Operative Sugar Mills Ltd.

The petitioner would submit that since there were wrong entries in the original Pension Payment Order (PPO) issued to him with respect to the date of birth, date of joining service, date of retirement, date of past service and actual service, pensionable service and wages, he had given a representation dated 15.09.2022 to respondents 1 to 4 to correct the above said wrong entires and issue Revised PPO.

As the respondents have not taken action on the representation dated 15.09.2022, the petitioner had filed WP.No.4268 of 2023 seeking a mandamus directing the 1st respondent to consider his representation and pass orders. This Court by order dated 21.02.2023 had allowed the Writ Petition directing the 1st respondent to consider the petitioner's representation dated 15.03.2022 and pass orders within a period of 6 weeks.

5. Despite the orders of this Court, the respondents had not passed any orders within the time frame and finally after giving several reminders and requests, the 1st respondent had revised PPO after a period of one and a half years i.e. on 12.09.2024.

6. The petitioner would submit that in the revised PPO certain details like wage on date of exit and the pensionable salary have not been rectified. Therefore, the petitioner had sent a representation dated 30.12.2024 to the respondents for correcting the wrong entries made in the revised PPO dated 12.09.2024. However, to date no action has been taken on the said representation. Therefore, the petitioner has come forward with this Writ Petition.

7. Heard the learned counsel on either side.

Considering the limited request and the fact that the respondents have failed to discharge their statutory duties, directions are issued to the 1st respondent to consider the representation of the petitioner dated 30.12.2024 and pass necessary orders in accordance with law within a period of 2 months from the date of receipt of a copy of this order and immediately report compliance to Court by filing a memo. are already in contempt for not having complied with the order passed in WP.No.4268 of 2023.

9. Accordingly, the Writ Petition is allowed.
