ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of Mandamus directing 2nd and 3rd respondents to take immediate and appropriate action to modify patta bearing Patta No.23 in respect of the property comprised in Survey no.182/9 and consequently make correction in all relevant revenue records.

It is submitted by the learned counsel for petitioner that petitioner submitted an online application on 05.02.2024 before the 3rd respondent seeking inclusion of petitioner's name in Patta No.23 and correction, which came to be rejected on the ground of non-production of parent documents. Thereafter, petitioner submitted a fresh online application with parent documents on 01.10.2024, it is stated that enquiry has been conducted on the online application by the 4th respondent, however, necessary changes in patta has not been carried out. Petitioner thereafter submitted representations on 08.05.2025 and 2/6

04.06.2025 requesting the respondents 2 and 3 to take appropriate action on petitioner's application, the same is stated to be kept pending. Hence this writ petition.

At the outset, it is submitted by Mr.S.J.Mohammed Sathik, learned Government Advocate for respondents that they would consider petitioner's online application dated 01.10.2024, representations dated 08.05.2025 and 04.06.2025 would be considered and appropriate orders would be passed in accordance with law after affording the petitioner and other interested parties a reasonable opportunity of hearing within a time frame to be fixed by this Court. Agreed to by the learned counsel for petitioner.

In view of the limited relief that is prayed, this Court is inclined to dispose of the writ petition with following directions: i) The appropriate respondent shall consider petitioner's online application dated 01.10.2024 and representations dated 08.05.2025 and 04.06.2025, after issuing notice and affording a reasonable opportunity of hearing to petitioner and all other interested parties including rival claimants, if any. ii) Though facts have been set out in affidavit, in view of the limited relief that is sought to be granted, I do not propose to examine the same, lest it may 3/6

influence the authority. The authority shall independently consider the facts and law set out in the representation and pass appropriate order in accordance with law including but not limited to the provisions of the Tamil Nadu Patta Pass Book Act and Rules.

iii) The petitioner's online application dated 01.10.2024 and representations dated 08.05.2025 and 04.06.2025 shall be disposed of within a period of 8 weeks from the date of uploading of web copy without waiting for the receipt of certified copy.

iv) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioner and all other interested parties are left open. No costs. 31.07.2025 Speaking (or) Non Speaking Order Index : Yes/ No mka 4/6
