PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to call for the records pertaining to F.I.R. No.1098 of 2016 on the file of the 1st respondent and quash the same insofar as this petitioner/accused No.1 is concerned.

O R D E R

This Criminal Original Petition has been filed to quash the F.I.R. No.1098 of 2016 on the file of the 1st respondent against the petitioner for the offences under Sections 406 and 420 of I.P.C.

2. The crux of the allegation is that the accused under the protest of reserving the tickets for the defacto complainant received more than Rs.9,52,000/-. Thereafter it appears that he has not done such reservation and committed cheating. As prima facie allegation is made out against accused, the same has to be unearthed during the investigation. In such view of the matter, the case in F.I.R. No.1098 of 2016 on the file of the 1st respondent cannot be quashed at this stage.

3. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
