ORDER

When the matter was taken up for hearing today, the affidavit of the 2nd respondent was filed before this Court. The relevant portions are extracted hereunder:

I respectfully submit, on 01.09.2025, the Tahsildhar, Kallakurichi District gave a requisition letter to the Sub Inspector of Police, Chinnasalem Police Station seeking to adequate police protection to survey the petitioner land in Survey No.431/10B, 441/78 and Natham Survey No. 1115/9 on 04.09.2025 at morning 10.00 hours.

7. I respectfully submit that as per requisition given by the Tahsildhar, Kallakurichi District, on 04.09.2025, I along with Tr. Devamoorthy. Sub Inspector of Police, Tmt Rabecal, Sub Inspector of Police and other 8 Police Personnel's adequate Police Protection to survey the demarcate boundaries comprised

in Survey No.431/10B, 0.51.0 Acres 1.26 Acre in 0.50 cents in Land and in Survey No.441/6A one Coconut Tree in Survey No.441/7B, 0.39.0 Ares in 0.90 cents in 0.35 cents in land and the total extend of 0.85 cents and in Survey No 441/7B. After survey the land and fixed the boundaries, the Tahsildhar stating that the petitioner has no actual possession or cultivation experience in the lands thus measured. Survey Field Nos. 431/10B and 441/7B are currently in the possession of the legal heirs of Thangavel, son of the late Mari Officer, who is actively engaged in agricultural activities therein. Further, Survey Field No. 1115/2, situated in Natham area, is currently a vacant plot containing a dilapidated structure, and no individual is presently residing or engaging in any activity or enjoying the said land.

2.The learned Government Advocate appearing on behalf of the 1st respondent produced the written instructions received from the Tahsildar, Chinna Salem. On going through the same it is seen that the survey was conducted.

3.The learned counsel for the petitioner submitted that the survey was not conducted in the presence of the petitioner and in any case the copy of the survey report has not been given to the petitioner.

4.There shall be a direction to the 1st respondent to serve the copy of the survey report to the petitioner on or before 26.09.2025. If the petitioner has any further grievance, it is left open to the petitioner to workout her remedy in the manner known to law.
