Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the third respondent to restore the 1/5

patta in petitioner name in respect of the house sit plot situated at Nagamarai Village, Pennagaram Taluk, Dharmapuri District comprised in S.No.443/18 after conducting due enquiry.

O R D E R

The petitioner herein seeks a direction to the third respondent to restore the patta in her name in respect of the house site plot situated in S.No.443/18 at Nagamarai Village, Pennagaram Taluk, Dharamapuri District.

According to the petitioner, the patta in the above mentioned property originally stood in the name of the petitioner, but the name of the fifth respondent was wrongly entered in the revenue records in respect of the said land. Therefore, the petitioner submitted a representation on 08.08.2019 before the third respondent seeking restoration of patta in her name, the same has not been considered. Aggrieved by the same, the petitioner is before this Court.

3. Mr.U.Baranidaran, learned Additional Government Pleader, who takes notice for the respondents 1 to 4 would submit that the representation of the petitioner will be considered, in accordance with law, within a time frame fixed by this Court.

In view of the same, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the first respondent to forward the representation submitted by the petitioner dated 25.03.2024 to the third respondent, within a period of two weeks from the date of receipt of a copy of this order. The third respondent shall consider the same and pass final orders, within a further period of 8 weeks, after issuing necessary notice to the petitioner as well as the fifth respondent.

5. With the above direction, this Writ Petition is disposed of. No costs.
