This Criminal Original Petition has been filed to call for the records, in C.C.No.874 of 2016, on the file of the Judicial Magistrate, Alandur, Chennai-16, quash the proceedings.

2. Heard Mr.K.S.Kumar, learned counsel for the petitioner, Mr.S.Vinoth Kumar, learned counsel for Public Prosecutor for Respondent 1 and Mrs.C.Shyamala, learned counsel for the respondent 2.

3. Mr.S.Vinoth Kumar, learned counsel appearing for Public Prosecutor for R.1 submitted that out of six witnesses, four witnesses have been examined.

In such a view of the matter, this Court is of the view that as the evidence is almost completed before the trial Court, trial Court has to appreciate the evidence and find out whether the evidence constitute any of the offences. Hence, this Court is not inclined to quash C.C.No.874 of 2016, pending on the file of the learned Judicial Magistrate, Alandur, Chennai.

5. In the result, this Criminal Original Petition is dismissed. It is open to the petitioner to raise all his defense before the Trial Court. Consequently, the connected miscellaneous petitions are closed Sd/- Assistant Registrar(CS IV) //True Copy// Sub Assistant Registrar nr/mvs To
