Respondent Prayer : Petition filed under Article 226 of the Constitution of India praying for issuance of writ of mandamus directing the respondents to deliver the physical possession along with all original documents of the immovable property in Item No.1 of the schedule mentioned property in the Sale Certificate which was purchased by the petitioner by Public Auction situated at Door No.14, Reddy Street, New Door No.15/A, now known as Kambar Street, Alandur, Chennai 600 061, as per Sale Certificate dated 28.05.2024. For Petitioner :

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) After the matter was heard for some time and affidavit and counteraffidavits filed, Sri.Muthukrishnan states that all documents have been received and he hopes, there will be no impediment in getting the documents registered. Mr.Ganesh, on instructions, states that if there is any impediment, the bank, which has received over Rs.8 crores wayback in May 2024, shall extend all cooperation.

2. Sri.Muthukrishnan states that he shall apply to the concerned authority for registering the documents and once he received the appointment, he shall inform Ms.Sathyabama, Assistant General Manager, Punjab National Bank, who is present in Court and Ms.Sathyabama shall make herself available at the appointed date and time.

3. Since the matter has been resolved, the bank need not pay any interest as directed in paragraph 4 of the order dated 12.12.2024.
