Versus

Abdul Hakkim ... Respondent This case came up for settlement before the Lok Adalat. Mr.Anton Dhanasekaran, learned counsel for the appellant. After mutual discussion and negotiation between both parties they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT As against the award amount of Rs.10,91,500/- with interest at the rate of 7.5%, the parties have agreed to settle for a total sum of Rs.12,75,000/- in full quit. Out of which, a sum of Rs.10,25,000/- was already deposited to the credit of M.C.O.P.No.2221 of 2017. 2.In view of the above, the settlement for the total sum of Rs.12,75,000/- (Rupees Twelve Lakhs Seventy five Thousand only) as full quit is recorded.

3.The appellant undertakes and as such is directed to deposit the balance amount of Rs.2,50,000/- within a period of eight weeks from today. The Claimant/respondent will be entitled to withdraw the settled sum of Rs.12,75,000/- on proper identification and verification in accordance with the terms of the award, without insisting on any formal permission petition.

4.In view of the same, the Civil Miscellaneous Appeal stands disposed off. Consequently, the connected miscellaneous petition/s is/are closed, if any.

This Lok Adalat award is passed in terms of the above settlement. The full court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court Fees and suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 2 r/w 25 of LSA Act 1987 as amended in 1994.
