Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 186, 332, 353, 324, 506 (2), 34 of IPC in Cr.No.1240 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complaint who is working as constable and he was on regular patrolling duty, at that time, the petitioner along with other accused came by motorcycle without head light, on seeing him, they turn the motorcycle and tried to escape and he tried to stop them, but, they through the stones over the head and assaulted the defacto complainant with wooden log, due to that he sustained injuries. Hence, the complaint. 3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that co-accused had already been released on bail. Hence, he prays for grant of anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Government Advocate (Crl.Side) submitted that the petitioner along with other accused persons had attacked the defacto complainant with stones and wooden log and caused injuries. He further submitted that the investigation is pending in this case and there is one previous case pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that the petitioner is involved in a very serious offence and there is one previous case pending against the petitioner and the investigation is at initial stage, this Court is not inclined to grant anticipatory bail to the petitioner..
