ORDER
This petition has been filed seeking for the transfer of investigation in Crime No.524 of 2023 which is pending investigation on the file of the fourth respondent.
2. The learned Senior Counsel appearing on behalf of the petitioner submitted that the respondents 2 and 3 are interfering with the investigation and they are dictating as to how the case will have to be proceeded further. The learned Senior Counsel submitted that in view of the same, the fourth respondent is not able to do an effective investigation in this case.
3. The learned Additional Public Prosecutor submitted that the F.I.R was registered only on 05.08.2023 and there are 21 accused persons in this case and already all the accused persons have been arrested. The learned 2/5
Additional Public Prosecutor submitted that the fourth respondent is effectively going ahead with the investigation and there is no interference from the respondents 2 and 3 in the investigation.
4. Taking into consideration the facts and circumstances of the case and the submissions made on either side, there shall be a direction to the fourth respondent to independently proceed further with the investigation in this case and respondents 2 and 3 shall not interfere with the investigation and the first respondent will ensure that respondents 2 and 3 do not interfere with the investigation. The fourth respondent will proceed further with the investigation and complete the same as expeditiously as possible and file a Final Report.
5. This Criminal Original Petition is disposed off with the above directions.
