ORDER

This writ petition has been filed for a mandamus, seeking for a direction to effect transfer of patta in favour of the petitioner for the properties morefully described in the prayer to this writ petition, based on the petitioner's application dated 13.06.2025 within a time frame to be fixed by this Court.

2. Since the aforesaid application of the petitioner seeking for issuance of patta for the properties has not been considered till date, the petitioner has filed this writ petition. The petitioner claims that they have acquired the properties by way of public auction conducted under the SURFAESI proceedings.

3. No prejudice would be caused to the respondent if the petitioner's application, seeking for issuance of patta for the properties morefully described in the prayer to this writ petition is considered on merits and in accordance with law within a time frame to be fixed by this Court.

4. This Court is not expressing any opinion on the merits of the petitioners' application. If needed the respondent shall also issue notice to the neighbouring land owners and any third party, in case any objections have been raised by them before passing final orders on the petitioner's application seeking for issuance of patta.

5. For the foregoing reasons, this writ petition is disposed of by directing the respondent to pass final orders on the petitioner's application dated 13.06.2025 on merits and in accordance with law seeking for issuance of patta in their name for the properties morefully described in the prayer to this writ petition after hearing the objections if any from the neighbouring land owners or from any third party, whom the respondent deems fit to enquire within a period of twelve weeks from the date of receipt of a copy of this order.
