Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 3 herein to remove the encroachment made by Respondent Nos.4 to 12 herein on the water body namely 'Snana Kulam' classified as "Government Poramboke" in S.No.55/2 situated at Eduthukatti Village, Tharangambadi Taluk, Mayiladuthurai District by considering the petitioner's representation dated 28.04.2025 within a time frame fixed by this Court.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) As against the allegation of inaction on the part of official respondents in removing the encroachment made by way of construction over the waterbody on Government Poramboke land situated in S.No.55/2 situated at Eduthukatti Village, Tharangambadi Taluk, Mayiladuthurai District, the learned counsel for the State, on

advance copy, would submit that based on the complaint made, a survey has already been conducted and certain parts of construction are objectionable and therefore, steps are being taken to issue notice for removal of encroachment.

2. Taking into consideration that a representation was made on 28.04.2025 and that respondents have also conducted survey by now, it cannot be said that respondents are guilty of inaction. Therefore, we are not inclined to keep this petition pending. Petition is disposed of. There shall be no order as to costs.
