ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 379 and 430 of IPC r/w 21(1) of Mines & Minerals (Development & Regulation) Act, 1957 in Crime No.181 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that on 30.06.2021 the case of the petitioner involved in illegal sand theft of 1 unit at the time the inspection and while the police officials intercepted the petitioner had wordy quarrel with them and the Inspector of Police had registered a case alleging that the petitioner had transported sand at the time of night inspection. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner illegally transported 1 unit of sand without permission and 4 previous cases pending against the petitioner. However, he vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the allegations and the nature of the offences involved in this matter and 4 previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
