The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 447, 294(b) and 506(i) of IPC, in Crime No. 325 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant's 2nd son namely Rajkumar is running a South Star Overseas Education Pvt. Ltd., for conducting counselling to the students, who are willing to go for abroad for education. While so, the said Rajkumar's friend one Ajay asking a sum of Rs.13 lakhs and the same was given as a loan amount to said Ajay's father through three instalments by way of cash. On 12.06.2023, when the said Ajay came from London the said Rajkumar asked him to return his amount and the petitioner along with other accused abused him in filthy language and threatened him with dire consequences. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that due to financial dispute between the defacto complainant's son and the petitioner a false complaint has been foisted and the petitioner has nothing to do with the alleged offence. He would also submit that the petitioner is ready to abide by any stringent condition imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl. Side) for the respondent would submit that due to money dispute between the petitioner and the defacto complainant's son, the petitioner along with other accused trespassed into the defacto complainant's house and abused him in filthy language and threatened him with dire consequences. Hence, he objected to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner, the learned Government Advocate for the respondent.

6. Considering the overt act and alleged action of the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 04.09.2023 ata
