PRAYER in W.P.No.2816 of 2023 : Petition filed under Article 226 of the Constitution of India, praying for issuance of writ of mandamus directing i) the second respondent herein to comply with the direction given by the first respondent in his letter with Reference No.7675/C/2022-1 dated 26.10.2022 within a time frame as may be fixed by this Hon'ble Court may deem fit and ii) to report the compliance of this petitioner's request made in his appeal dated 12.09.2022 to this Hon'ble Court by all the respondents. PRAYER in W.P.No.8756 of 2023 : Petition filed under Article 226 of the Constitution of India, praying for issuance of writ of certiorarified mandamus, to call for the records relating to the impugned letter with Reference No.4629/ IE- 2/ 2021 dated 31.10.2022 and letter with Reference No.4629/IE-II-2/2021

dated 20.01.2023 issued to the petitioner by the office of the third respondent under the directions of the respondents 2 & 3 marking copies of the same to the fourth respondent and quash the same and direct all the respondents for survival of this sick unit i) to implement their acceptance and decisions confirmed in their letters dated 19.05.1983, 23.07.1990, 03.01.1991 and 20.10.2021 and second para of eviction order dated 14.02.1992 to waive all the interests accrued towards principal amount of loans amounting to Rs.

1,72,580/- and other concisions given under sick unit's rehabilitation scheme which they as committee members of various sick industries Rehabilitation Committees during their rehabilitation of this sick unit for its survival and amend the terms and mode of repayment of loan furnished in the Allotment Order and Leasecum-Sale Agreement of the Plot No.20, SIDCO Industrial Estate, Ranipet - 632 403 according to these acceptances and decisions, within a time frame as may be fixed by this Hon'ble Court may deem fit and ii) to report their compliance of this prayer to this Hon'ble Court.

Ms.Sithara Sarangan Standing Counsel C O M M O N O R D E R Since the issue raised in all the writ petitions is one and the same, with the consent of the learned counsel appearing on both sides, all these writ petitions are heard together and are being disposed of by this common order.

The petitioner, who is appearing as party-in-person, submitted that he had entered into a Hire Purchase agreement with the fourth respondent, namely, Estate Officer-cum-Branch Manager in respect of the subject property. It was alleged by the fourth respondent that the petitioner had committed default in payment of the agreed consideration and consequently, the agreement came to be cancelled by the fourth respondent. Despite such cancellation, the petitioner continued to remain in occupation of the premises and therefore, the petitioner was treated as an unauthorised occupant within the meaning of Section 2(g) of the Tamil Nadu Public Premises (Eviction of Unauthorised Occupants) Act, 1975 and eviction proceedings were initiated against him under the provisions of the Act.

3. Aggrieved by the order of eviction, the petitioner preferred an appeal before the District Court, Vellore in C.M.A.No.1 of 1990. The said appeal was disposed of with a direction to conduct a fresh enquiry. Pursuant thereto, the fourth respondent reconsidered the matter and the fourth respondent, by order dated 14.02.1992, once again directed eviction of the petitioner from the subject property. Challenging the said order, the petitioner preferred an appeal before the District Court, Vellore, and the District Court by judgment and decree dated 03.09.2004, dismissed the appeal and confirmed the order of eviction. Assailing the said judgement and decree, the petitioner filed writ petition in W.P.No.11931 of 2024 before this Court. The writ petition came to be

dismissed by the learned Single Judge on 26.09.2024. Aggrieved thereby, the petitioner preferred writ appeal in W.A.No.3269 of 2025, which also came to be dismissed on 10.11.2025. Challenging the said judgment, the petitioner has preferred a Special Leave Petition before the Hon'ble Supreme Court and the same is pending consideration.

The learned Standing Counsel appearing for the respondents submitted that the order of eviction has already been confirmed by the competent fora and that the petitioner has exhausted all remedies available to him. He further submitted that no further relief can be granted in the present writ petitions and that the petitioner has to await the verdict of the Hon'ble Supreme Court in the Special Leave Petition.

5. This Court has considered the submissions made on either side and perused the materials available on record.

It is not in dispute that the petitioner had entered into a Hire Purchase Agreement with the fourth respondent in respect of the subject property and that, upon cancellation of the agreement, eviction proceedings were initiated under the provision of the Tamil Nadu Public Premises (Eviction of Unauthorised Occupants) Act, 1975. The challenge made by the petitioner to the order of eviction was unsuccessful before the District Court, the learned

Single Judge of this Court and also before the Division Bench in the writ appeal. It is also brought to the notice of this Court that a Special Leave Petition preferred by the petitioner against the said judgement is presently pending consideration before the Hon'ble Supreme Court.

7. In such view of the matter and having regard to the facts and circumstances of the case, this Court is of the opinion that, no further orders are required to be passed in these writ petitions. Accordingly, these Writ Petitions are closed. However, liberty is granted to the petitioner to work out his remedies in the manner known to law, in the event of his succeeding in the proceeding presently pending before the Hon'ble Supreme Court. No costs. Connected miscellaneous petition is closed.
