For the reasons stated in the accompanied affidavit, especially for the reason that M.P.No.1 of 2012 came to be dismissed for want of availability of E.B in the said Miscellaneous Petition and the same appears to have gone out of notice of the learned counsel and the same was dismissed along with bulk matters, this Court is inclined to condone the delay of 3322 days. Accordingly, the delay is condoned.

2.Learned counsel for the petitioner is permitted to make available a duplicate copy of M.P.No.1 of 2012 to the Registry today and Registry is directed to re-construct M.P.No.1 of 2012 and list on 16.12.2024.
