Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st Respondent herein to release the Vehicle namely Ashok Leyland Tarrus Lorry in bearing Registration No.AP-26-TF-2769 to the petitioner. ORDER
The petitioner herein has approached this Court seeking a direction to the first respondent herein to release the petitioner's Lorry bearing No.AP26-TF-2769 which was taken into custody of by the Authorities on the allegation that certain quantity of PDS rice was smuggled through that Lorry.
2.The learned counsel for the petitioner submitted that earlier a petition was filed for the same purpose but, in the Order copy, the Lorry Number was wrongly given.
3.Mr.G.Ameedias, learned Government Advocate takes notice for the first respondent.
4.Mr.N.Muthuvel, learned Government Advocate (Crl. Side) takes notice for the second respondent.
5.The learned Government Advocate appearing for the first respondent submitted that so far as the present petition is concerned, the petitioner 2/4
did not refer to the earlier proceedings in W.P.No.17851 of 2023 and the order passed therein on 16.06.2023. Further that, Vide that order this Court directed the petitioner to deposit Rs.2,00,000/- as a pre-condition for releasing the lorry. He added that an enquiry was initiated, in which, the petitioner had participated at least twice. 6.If any factual details are wrongly given in any order, all that the petitioner needs to do is to approach the concerned Court, to have the matter listed under the caption 'for being mentioned' to have it corrected. 7.This Court directs the petitioner to resolve to the procedure indicated. 8.The Writ Petition is accordingly disposed of.
