Mr.G.Nanmaran, learned Special Government Pleader takes notice on behalf of the respondents. By consent, the writ petition is taken up for final disposal at the admission stage itself. 2.The writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus to call for the records of the impugned order dated 27.03.2025 in Na.Ka.No.24575/2023/Tha1 passed by the second respondent and quash the same and consequently to direct the second respondent to reinstate the petitioner with all consequential service benefits.
3.When the writ petition is taken up for hearing, the learned Special Government Pleader would submit that the petitioner has already preferred an appeal before the Appellate Authority on 30.05.2025 and such appeal is pending.
4.At this juncture, the learned counsel appearing for the petitioner would submit that the Appellate Authority has not 2/4
considered the appeal preferred by the petitioner. 5.Though the petitioner has preferred appeal challenging the order of the Disciplinary Authority, the grievance of the petitioner is that the appeal has not yet been disposed of by the first respondent. 6.In view of the above factual position, without going into the merits of the writ petition, this Court deems it appropriate to direct the first respondent to consider the appeal preferred by the petitioner on 30.05.2025, upon its own merits and in accordance with law and pass orders, within a period of four weeks from the date of receipt of a copy of this order.
7.The writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
