ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 31.10.2021 for the offences under Sections 449, 147, 170, 364A, 368 of IPC, in Crime No.379 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the on 27.10.2021 about 9.00 p.m., the petitioner along with other accused persons trespassed into the house of the de facto complainant and kidnapped her husband by falsely representing that they are police officials and thereafter, demanded a sum of Rs.2,00,000/- to release her husband. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for more than 30 days from 31.10.2021 and hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the victim is a Financier. There are totally 7 accused involved in this case and the petitioner is arrayed as A1. Though the victim has been secured and some of the accused namely A2, A6 and A7 have been arrested, the other accused namely A3, A4 and A5 have been absconding and the investigation is at the initial stage.

5. On seeing the grave nature of allegation against the petitioner and that 3 of the accused are still absconding and the investigation is at the initial stage, this court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
