ORDER

This Writ Petition is filed to issue a Writ of Certiorarified Mandamus to call for the records of the 3rd Respondent in final notice dated 12.9.2016 in Na.Ka.A2/1206/2016 and to quash the same and to direct the 3rd Respondent to furnish a copy of the complaint made by the 5th Respondent, upon which the proceedings are initiated by the 3rd Respondent, to the Petitioner and thereafter, to proceed in accordance with law.

2. This court heard the learned counsel on either side and also perused the materials placed on record.

3. The Petitioner has challenged the summons dated 12.09.2016 and as per the summons, he also appeared for enquiry on 23.09.2016 and now the case has been adjourned without date. The only grievance of the Petitioner is that for participating in the enquiry, he must have the basic information, namely, the alleged complaint made against him by the 5th Respondent to the 3rd Respondent and without a copy of the said complaint, it is difficult for him to contest the case in accordance with law and therefore, he now restricts his prayer to direct the authority concerned only to give a copy of the said complaint alleged to have been given by the 5th Respondent to the 3rd Respondent. In that view of the matter, since he is not challenging the impugned summons, no further order is necessary. However, the Petitioner is given liberty to approach the concerned authority to get a copy of the alleged complaint made against him which shall be provided by the Respondent.

4. With the above directions, this Writ Petition is disposed of. No costs. Consequently, the connected MP is closed. -sd/- Assistant Registrar / TRUE COPY / Sub-Assistant Registrar Srcm To:
