CMP No.20839 of 2023 in CMA.SR.No.109850 of 2023 N.ANAND VENKATESH.,J The respondents 1 and 2 remained ex-parte even before the Tribunal. They have been served notice in this appeal and their names have been printed in the cause list. The 3rd respondent has also been served with notice.

2.Mr.M.Krishnamoorthy, undertakes to file vakalat for the 3rd respondent.

3.This Civil Miscellaneous petition has been filed seeking to condone the delay of 123 days in filing the Civil Miscellaneous Appeal.

4.Heard the learned counsel for the Appellant and perused the records.

5.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 123 days is condoned.

6.The name of the counsel for the 3rd respondent shall be printed in the cause list at the time of admission.

7.It is made clear that for the period of delay of 123 days, the appellants will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
